90-MINUTE JUDGMENTS: Probation and Negligence

According to the Industrial Relations Act (Sec. 10:3), "...the Court in the exercise of its powers shall: (a) make such order or award in relation to a dispute before it as it considers fair and just, having regard to the interests of the persons immediately concerned and the community as a whole…”.

In this regard, careful study and analysis of judgements coming out of the Industrial Court of Trinidad and Tobago are useful to inform and direct future behaviour, policies and decisions in relation to matters that involve employers and employees. Having knowledge of, and understanding these statutes can therefore offer essential guidance on managing workplace issues in accordance with the principles of good industrial relations practice.

TOPICS TO BE COVERED

In each session, specific Industrial Court judgments will be analysed to identify the key issues and lessons employers can extract for future decision-making. These judgments will cover themes such as:

  • Dismissal while on probation - Where management go wrong
  • Can you dismiss a probationer on a fixed-term contract?
  • Analysing key judgments emanating from the Industrial Court on probation

  • Definition and key elements of negligence
  • HR's role in reducing the risk of negligence
  • Analysing key judgments emanating from the Industrial Court on negligence

Akida Mohammed holds a degree in Sociology and Economics from the University of the West Indies and has been trained by ILO in Conciliation and Mediation, Joint Union/Management Negotiation Skills and Facilitation of Union/Management Negotiations. She has over twenty (20) years of experience in the public and private sectors in Trinidad and Tobago. She was the Registrar of Trade Unions - responsible for the Trade Union’s Act and audit of all Trade Unions, Senior Conciliator at the Ministry of Labour, Examiner with the RR&CB (Registration, Recognition and Certification Board).
